RENTAL AGREEMENT FOR MIDWEEK, WEEKEND AND WEEKLY RENTALS
(note if you are renting monthly you will have us draw up a special monthly rental agreement)



When you make your reservation we require that you read this page online and when you book your reservation we require that you send us an email saying that you have read this agreement and do agree with all the terms and conditions of the agreement.

Brady Family Partnership, owners of the property known as 307 Capitola Ave, Capitola, Ca 95010, provide all furnishing cooking utensils, and dishes, pots, coffee maker, microwave, refrigerator, linen, and access to a non-coin operated washer and dryer, wifi, and cable tv.

All payment is taken prior to arrival. You may pay via credit card. Visa, Mc, American Express, Discovery Card. Sorry, we do not accept checks unless they are on a local bank.

A SECURITY DEPOSIT IS NOT REQUIRED FOR NIGHTLY AND WEEKLY RENTALS, HOWEVER TENANT/GUEST HEREBY AGREES TO ALLOW OWNERS TO CHARGE THEIR CREDIT CARD ON FILE FOR ANY AND ALL DAMAGE OR LOSS TO THE PREMISES, NOT TO EXCEED $250.00 two hundred fifty and no/100 us. A list of all furnishings is posted in the apartment suite. We ask that you look it over, and report upon arrival any missing or damaged item so you will not be charged for it.

PARKING PERMIT Owners provide one rare parking permit per unit/apartment suite, which allows tenant to park almost anywhere in Capitola Village day or night, even in metered spaces. TENANT HEREBY AGREES TO LEAVE THE PARKING BEHIND UPON DEPARTURE (to be left inside the apartment suite); should tenant neglect to do to do this he/she does hereby agree to all us to charge $50 fifty and no/100 dollars (the cost of replacement) for this permit. And does also hereby agree to allow us to charge tenant's credit card for this replacement cost.

CANCELLATION REFUND POLICY: We must be able to re-book/re-rent all the dates you have reserved in order for you to receive a fund. If you wish to have us try to re-book the dates you have reserved please do remember to do so as soon as possible, since it will give us more time to find someone to take your dates, the closer the time is to your schedule arrival the more difficult it is to re-book/re-rent. If we are not able to re-book/re-rent all of the dates, but might be able to find someone for some of the dates let us know this so we can make that option available to people wanting shorter periods of time, it would allow you a better chance for success in finding a party to take at least a portion of the time you have reserved?

PETS:
Pets are not allowed in the premises, unless specifically stated in a separate agreement in writing, and with a pet deposit and special additional charge to de-flea premises.

SMOKING:
Smoking is not allowed in or around Premises. Lingering smoke smell can be costly to remove from curtains, carpets, walls, furniture, etc. and Guest agrees that if after departure Owner is unable to remove the smell, that tenant will be charged to repair the damage.

QUIET REQUIREMENT:
We strive to create a quiet environment for neighbors and guests, and ask that Tenants/Guests respect others by keeping voices, TV’s and foot traffic at low volume. Any complaints from neighbors regarding excessive noise or other nuisances may be cause for immediate termination of the Agreement and forfeiture of tenants deposits.

CHECK-IN:
Check in time is 3:00 on the day of arrival. (unless otherwise agreed upon).

CHECK-OUT
Check out is 12 noon; If check out is later than 12:30 noon, you will be charged $25.00 for each additional half hour over the check out time. And you do hereby agree that owners can charge your credit card for all overtime fees.

DAILY HOUSEKEEPING IS INCLUDED IN RATES.

MAINTENANCE:
Owner will diligently attempt to address maintenance issues as they occur. There is an associated risk of renting apartment suites. If a maintenance issue occurs that cannot be fixed in a reasonable amount of time and significantly affects tenant stay, Owner's Agent reserves the right to refund at their discretion or relocate Tenant to another apartment suite.

OWNER LIABILITY DISCLAIMER:
Owner will not be responsible for nor accept liability for any inconveniences arising from any temporary defects or stoppage in supply of water, gas, electricity or plumbing. Nor will Owner accept liability for any loss or damage caused by weather, road conditions, natural disasters, acts of God or other reasons beyond their control. Tenant takes full responsibility for themselves, their visitors and guests, including but not limited to all conditions caused by negligent or wrongful acts, injury and liability.

EXPRESS INDEMNITY:
The undersigned, for himself/herself, his/her heirs, assignor's, executors and administrators, fully releases and discharges Owner and their agents from any and all claims, demands and causes of action by reason of any injury or whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her guests as a result or, or in connection with the occupancy of the premises and agrees to hold Owner and their agents free and harmless of any claim or suit arising there from. In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, agents, successors or assignees the prevailing party shall be entitled to recover reasonable attorney fees and costs.

ENTIRE CONTRACT:
Time is of the essence. All prior agreements between Owner and Tenant are incorporated in this Agreement, which constitutes the entire contract. It is intended as a final expression of the parties Agreement and may not be contradicted by evidence of any prior agreement or complete and exclusive statement of its terms, and that no extrinsic evidence whatsoever may be introduced in any judicial or other proceeding, if any, involving the Agreement. Any provision of the Agreement that is held to be invalid shall not affect the validity or enforce ability of any other provision in the Agreement. The waiver of any breach shall not be construed as a continuing waver of the same or any subsequent breach. This Agreement shall be governed and construed in accordance with the laws of the State of California. California shall have personal jurisdiction over the parties and the county in with the Premises is located shall be the forum for any legal action brought in relation to the Agreement.
