VACATION/SHORT TERM OR MONTHLY RENTAL AGREEMENT
This sample agreement will need to be altered to accommodate specific rental needs,
since terms and conditions will vary depending on if you are renting weekly or you
are renting monthly. We alter the agreement and email it to for your signature and
you then fax it back to us. After payment is received we send confirmation and the
entry instructions, and other useful information for your stay in Capitola Suites.
However, in the meantime you should start the reservation process by phoning us or
emailing us the specific dates of rental; Apartment Suite Number; total number of
guests to be accommodated. Be sure to include your address and phone number so we
can phone you for your credit card information required for payment.

TERM OF RENTAL:
This is a (weekly/monthly) rental.
Rental begins on ________________, 2008 at 3pm; and ends at 12 noon on ______________.

COST OF RENTAL:
Number of weeks or months X weekly or monthly rate (see rate schedule);
Add a Security Deposit (refundable if left as agreed) $775.00 for weekly rentals;
and $1,275 for monthly rentals; Add a non-refundable Departure Cleaning Fee of $125;
and a refundable $100 Parking Permit Deposit (refundable if left behind upon departure).
Note: Refund policy requirements below for each required deposit
PAYMENT IS DUE AND PAYABLE AS FOLLOWS:
Visa, Mastercard & American Express cards and Cash are accepted.
Sorry, we do not take checks at this time.
We require 1/2 of Grand Total Amount (see COST OF RENTAL above) to secure dates. And the
remaining 1/2 balance is due six (6) weeks prior to occupancy. Note: This balance will
be automatically charged to the same credit card on file, or a new card given if this
card has expired at the time the charge is due. When your card is processed and has it
has cleared; and this agreement is signed and faxed back to us, we will email you notice
of confirmation and along with entry instructions.
Note: The balance will still be due regardless of the fact that you may have requested
cancellation and be awaiting a person/s to re-book the dates you have rented. However
until these dates are actually rented you are still responsible for payment in full as
herein agreed upon. See the refunds requirements for cancellations below.
CHECK IN AND CHECK OUT REQUIREMENTS:
Checking in is always 3pm Checking out is always 12 noon (no exceptions). Our cleaning
crew arrives promptly between 12 noon and 12:15. They have only two hours, 45 minutes
to complete their tasks to make your apartment suite ready for our next guests who are
scheduled to arrive at 3pm. In the event you have not vacated the premises at the time
you agreed upon (12 noon) the cleaning crew will leave and will have to be called back
thereby creating a return fee of $125.00. We therefore will charge you for this cost
incurred by your 'Late Check Out" to compensate for this additional cost to us. Also
do note, that your credit card (whose number we keep on file) will be charged, and you
do hereby authorize this card to be charged this fee should a 'late checkout' occur.
REGARDING RATES AND THE NUMBER OF GUESTS PERMITTED:
We allow a maximum of two(2)persons per apartment suite unit, unless more persons are
agreed upon in writing (email acceptance ok). Note: We will consider accepting one(1)
additional adult guest per unit for an additional $50 fee per night for weekly rentals
You do hereby agree to this additional charge should you have any additional guests at
at any time during your stay, unless agreed upon otherwise in writing. You hereby do
agree to have the credit card we have on file for you charged a $50 per person fee for
any and all overnight guests in your unit, agreed upon in advance or not.
PARKING, AND PARKING PERMIT REFUNDS:
We provide one official 'Parking Permit' per unit. This permit will allow you to park
almost anywhere in Capitola Village day and night (with only a few exceptions). There
is a $100.00 refundable parking permit deposit for this valuable parking permit
so do not misplace it, or let others use it since your refund requires that you leave
it behind you in your unit upon your departure.
QUIET REQUIREMENT RULE:
We strive to create quiet, peaceful and tranquil environments for all of our tenants in
the building, and ask that you respect your neighbors in the building by keeping voices
tvs and radios at low volume. And if you have an upper level unit that you remove shoes
and walk softly in consideration of the guests in the unit below you. We know that for
some this requirement might be asking too much; if this is the case, please only rent a
ground floor apartment suite unit. Do please note: These apartments are for adults only
and should you have a young visitors it is your responsibility to make sure that your
guests young and old do not run up and down stairway, 'rough house', create loud music,
or otherwise make noise that could disturb other tenants. This would be a violation of
this agreement and result in loss of security deposit.

SECURITY/DAMAGE DEPOSIT AND REFUNDS:
Your 'Security deposit' amount is determined to be 1/2 of the first week (if you rent
weekly; or 1/2 the first months rent, if you are renting monthly. Your security deposit
will be refundable less any cost for damage ( including pet damage, smoke removal to the
carpets, drapes and furniture); replacement costs for broken or lost items, any cleaning
beyond the necessary normal departure cleaning service covered under non-refundable fee.
less cost or losses due to the violation of our quiet rule or our non-smoking rule e.g.,
which could result in your the entire security deposit being withheld should another of
our tenants ask for a refund due to your actions. Should a tenant bring suit against us
for failure to enforce the noise or non-smoking rule you hereby agree to pay court costs
and pay any and all damages resulting from your actions and losses to landlord or tenant.
Do further note that our cleaning crew makes note of any changes, and/or damage done to
the premises as they do their departure cleaning of your unit. They report all changes
and damage, and loss of items missing that are standard in each unit e.g remote controls
etc., This report goes directly to us and we promptly quote replacement costs and seek
repairs. Sometimes a repair quote will take several days to receive so any refund will
be held up awaiting the quote. All refunds due will be either credited to your credit
card or paid to you via a check within 30 days maximum of your departure.
DEPARTURE CLEANING COST:
A $125 non-refundable fee is charged at the time of rental. Your apartment suite unit
will be immaculate upon your arrival. Additional cleaning prior to your departure will
need to arranged for, and paid by you. You must use our cleaning crew (their phone no
will be posted in your unit (and no outside cleaning service is allowed because we only
we specific brands of cleaning products and damage to the fixtures could occur if they
use the wrong products and procedures on appliances and fixtures. There is an on-site
washer and dryer located on the side of the building in an alcove just past iron gate
entrance (you will be provided with a key to the gate and to the laundry alcove).
PET POLICY:
On rare occasions we do allow one (1) small, non-shedding barkless dog and a $500 fee
(which we will use to clean carpets and de-flea after the unit is vacated).
Note: Should your dog be left alone it will bark, so we are careful to only allow dogs
whose owners promise to the keep dog with them at all times (we do not make exceptions
to this rule, since we are dog owners ourselves and know that dog bark when owners are
not home, and the tranquility of our other guests is important to us.
NON-SMOKING RULE:
Sorry we do not accept smoking in or around the building at any time. Nor do we allow
tenants to have guests that smoke in or around the premises. Note: that up to $200 of
your security deposit money could be used to remove smoke from the carpets, drapes and
furniture. Plus non-compliance could result in a law suit filed on behalf of another
tenant for failure to enforce this rule and should a suit be won and damages awarded you
could be held liable. You hereby agree not to violate this non-smoking rule and if you
do you do hereby agree to be held liable for any damages resulting.
REFUNDS REGARDING CANCELLATIONS AND DAMAGES:
Refunds are given only when, and if, all of the dates you have rented are able to be re-rented.
There is a $75 cancellation re-booking fee. Your refund, if you are eligible for one,
will be less this re booking cancellation fee.
ALL REFUNDS DUE
After your departure when damage or non-compliance is noted, and all replacement or
repairs costs have been determined by outside repairmen etc., or additional cleaning
beyond normal departure cleaning costs are evaluated and determined, will any refunds
be made. This usually happens very quickly unless repair people are delayed making
assessments. In any event all refunds due you are to be made no later than 30 days of
your departure.
I have read this rental agreement and do hereby agree to all the terms and conditions
herein stated.
